EFT Energy Consultants, a company that helps businesses make savings on their energy consumption, is prompting businesses in the South Wales region to check if they need to comply with a compulsory energy assessment scheme, which has a deadline of 5th December.

The new compulsory legislation, the Energy Savings Opportunity Scheme (ESOS), is part of the EU Energy Efficiency Directive, which entails large undertakings and their corporate groups in the UK to measure and audit their energy use across buildings, transport and industrial activities to identify cost-effective energy saving processes. However, the implementation of the recommendations is not compulsory.

Any UK company that either employs 250 or more people, or has an annual turnover over 50 million Euro (£38,937,777) and an annual balance sheet total over 43 million Euro (£33,486,489), is considered a large undertaking.

The Environment Agency is the UK scheme administrator and businesses need to notify the Environment Agency by 5th December 2015 that they have complied with their ESOS responsibilities.

“This new legislation is highly likely to impact on many businesses across a wide range of sectors and so business leaders need to take note of whether they comply with the energy assessment scheme.

“It is worth highlighting that even though the 5 December deadline is set in EU law and therefore can’t be changed, there are no plans for enforcement actions to take place for late notification to the Environment Agency, as long as it is provided by 29 January 2016.

“It is crucial for businesses that are concerned that they will not be fully compliant by December 5th 2015 to consult with a lead assessor as soon as possible to assist with carrying out an energy audits and overall ESOS assessment.”
